Chief Justice David Maraga has told off the hawkish interior CS Fred Matiangi over his scathing attacks on the Judicairy.

Speaking to journalists on Thursday, The Chief Justice dismissed CS Matiang’i’s allegations that there was an evil clique of judges favouring the Opposition and civil society activists in their rulings.

“It is not true that any judges have been captured by the opposition, as it is being said,” he said.

The CJ advised CS Matiang’i to wait for the Court of Appeal’s decision if he does not agree with the rulings made by High court judge George Odunga and Lady Justice Roselyne Aburili on lawyer Miguna Miguna’s case.

“It is the orders they are issuing in their normal course of business. They could make mistakes in those orders. And we are saying, if they make mistakes, let there be an appeal. And when it is filed, wait for the matter to be dealt with,”
the CJ noted.

The CJ was however cautious and did not delve further into the matter noting that it was live in the court.

“That is why I do not want to comment on the minister’s comments. Let the Court of Appeal deal with that,” Maraga said.

On Tuesday, Mr Matiang’i appeared before the Parliamentary Committee on National Security and Administration to answer questions regarding Miguna’s forceful deportation where he made disparaging remarks that have since been condemned by the public, members of bar and even opposition leader Raila Odinga.
